                                     范例5.1 提要
   申请者概况
  申请人的丈夫在加拿大读物理学博士
 接近全奖但是差两干加元，加上配偶探亲总共还短缺四千加元
 申请人本人是大专文凭，职业为会计
  拒签理由
  资金不足
 有可能在加拿大转换身份
 毕业后没有使他们非回中国不可的因素，因此有移民倾向
  申诉重点
  当初你们给我丈夫签证时，他的奖学金就短缺两干加元
 现在我去探亲，只不过又增加了两干加元的额外费用
 两干加元和四千加元没有本质区别，因此不应该成为分开我家庭的理由
 以我可能犯但是没有犯的过错来拒签我，是不公平的
 当然我是不会犯你们怀疑的非法滞留罪的
 详细描述丈夫的工作和学习目的，论证他为什么要去学习、为什么一定会回来的原因
 从特定的个人事业的角度，申诉信实现了论证一个“典型环境里典型个性”的过程
                                     范例5.2 原文
   Dear Visa Officer ,
  Even though my visa application was rejected twice by your officer , i do think that I
 have a strong case and would like to present my reasons to your honorable visa officers
 as why I should be granted a visitor's visa. I respectfully request that you listen to
 my
 statement and give my application a reasonable re-evaluation:
  l. It is not fair nor reasonable that the visa office rejected my application on the
 ground
 that my husband's funding from the University of Waterloo has a mere $ l , 772
 dollars shortfall. The visa officer gave my husband a visa despite this shortfall but
 rejected mine because of the insufficient funds while an additional person costs only
 about $2,000 dollars more money. If the visa officer believes that my husband can
 support himself for $l,772 dollars, the visa officer should also believe that my
 husband and I can manage to support ourselves in a mere two thousand more dollars
 because there is no substantial difference between ;$2,000 and $4,000 dollars.
 This is an amount of money that I can make easily in a matter of several months as
 an accountant in Beijing. People would spend their life savings and even everything
 for their family if necessary. Is spending several months salary a big deal to me if
 the money can bring me and my husband happily together? If the money is too big
 and beyond the reasonable possibility of the earning power for a young professional
 working in Beijing , your rejection could be reasonable. However, denying my
 opportunity to see my husband just for a few thousand dollars is not a fair and sound
 judgment .
  2. In refusing my application ,the visa officer also wrote that I would be able to
 change
 my status from within Canada ,thereby remaining employed while spouse completes
 studies. This reason for rejection is even more unreasonable : What does the officer
 mean that "subject would be able to change her status from within Canada"? Does
 the law stipulate that only those who are NOT ABLE to change status from within
 Canada be granted a visa?
  I am not familiar with Canadian laws, however, I am familiar with that that I am a
 law abiding person and will be strictly observing the rules and regulations that my
 visitor's status limits. Denying my visa is punishing me for a crime I did not and will
 never commit.
  3. Specialized in acoustics physical chemistry ,my husband has been in the business in
 manufacturing hearing devices for the hearing handicapped people in China. By
 doing this, he has made a good name and good money. You may not know that the
 major reason he selected the University of Waterloo is because that the Guelph-
 Water Center is the largest research center for his field in Canada. Returning with
 his Ph. D. degree and more importantly with his advanced research in the hearing-
 aid technology, he will certainly make a fortune in the large Chinese market. If a
 person's real career and big fortune is not the strong tie to his homeland, in
 addition to his business contacts , social status and family connections , what else
 could be7 Given my husband's solid business ideas ,I believe that you will agree that
 we do have sufficient ties that will it "compel" our departure from Canada.
 Your re-evaluation and favorable consideration are greatly appreciated.

 一点钱算得了什么?如果牵涉到的金额实在太大，远远超出今日中国一个青年专业人
 士可能的工资水平，那么你们的拒签也许是合理的。但是，仅仅为几千加元而阻隔我
 去探望我的丈夫，实在是一个不公平不妥当的决断。
  2．在拒绝我的信中，签证官写道：我去了加拿大可以在当地改变我的身份，因而
 就可以在配偶完成学业之际寻求工作。这个拒签的理由简直更加不合理：签证官说
 “我可以在当地改变身份”，请问他这是什么意思?难道加拿大法律规定，只有那些在
 加拿大“不能”改变身份的人才有资格拿到签证吗?我对加拿大的法律并不了解，但
 是，我却了解我自己是一个遵守法律的人，我将严格遵守我的访问签证所要求的一切
 规定和限制。拒绝我的签证是对我从未犯过并且永远不会犯的罪行施行惩罚。
  3．我丈夫是一个声学物理化学专家。他一直从事的事业，是为中国的听力残障者
 生产和制造听力辅助设备。他在这个行业里获得了良好的名声和丰厚的收入。你们
 也许不知道，我丈夫选择滑铁卢大学的主要原因，就是因为那里的Guelph—Water研
 究中心是全加拿大在这方面最大的研究机构。从加拿大获得博士学位以及更重要的
 听力辅助的先进研究技术回到中国，我的丈夫必定能够在巨大的中国市场上赚很多
 很多钱。如果一个人的事业，前途，加上生意关系，社会地位，以及家庭背景都不是足
 够强大的纽带(吸他回国)，那么请问还有其他什么东西?考虑到我丈夫实实在在的事
 业设想，我相信你们会同意，我们确实有强大的纽带“驱使”我们离开加拿大。

                                   范例5.4 分析
   在李云的签证申请被第二次拒绝时，签证官给了她一封信。这封信中签证官提出的拒签理
 由非常不合理不公平(该信原文请看附录)。签证官在写完这些不合理的拒签理由后，告诉申请
 人她如果重新申请，必须等到一年以后。一个轻松的错误的判决，将一对幸福的中国夫妇的生
 活抛入水火之中一年，并担惊受怕来年再次申请时，又会再次惨遭滑铁卢(李云要去的城市，偏
 偏是加拿大安大略省的滑铁卢市的滑铁卢大学)。李云的丈夫，是在加拿大读博士学位，至少需
 要四年的时间。分居四年，怎么可能呢?
  李云被拒签两次之后，心中失望，简直不想去了。拿到这封申诉信，正好赶上出差，她居然
 写了一封委托书，让她的朋友把信递交给了使馆。不知道她是没有胆量去使馆碰壁呢还是对结
 果不抱信心。加拿大使馆的签证原则和美国一模一样，但程序不同。对于探亲签证的程序是：
 今天递交申请，明天就可以去取结果。第二天她的朋友帮她去取结果时，使馆的秘书告诉她结
 果还没有出来，第三天再来。等到第三天结果出来，她的签证下来了!
  导致李云被拒签的三个理由，是非常普遍的原因：资金不足，移民倾向，没有强大的回国纽
 带。读者可以仔细参考李云的申诉信，从中寻找符合你的情况的灵感和启发。但最重要的第三
 点，即国内没有足够的纽带使你回国这一项，值得读者仔细分析。李云是如何把一个最无法证
 明的东西：回国纽带，证明得这么生猛有力，使得签证官改变了连续两次的拒签决定?
  李云的成功的秘诀在于她的回国理由的“具体性”，这个理由不是一般的“国内有机会”这
 样普通的理由。她的理由非常具体而特殊，Specific and Unique．这个具体和特殊就是：丈夫是
 搞助听器研制生产的专家，加拿大的这个大学正好是研制助听器的权威机构，所以学成回国，
 他有巨大的前途。“如果一个人的事业，前途，加上生意关系，社会地位，以及家庭背景都不是足
 够强大的纽带，请问还有其他什么东西?”对于这样的问题，铁石心肠的签证官也会感动得内疚
 不已。每一个申请者，都一定要注意寻找自己的具体和特殊的事业和学业背景，从而给签证官
 一个具体可感的、“可信摸得着”的回国理由。
  关于具体性，本书在许多章节有很多论述，读者可参阅这些章节的论述。每天都有许多人
 要去美国读书。应该说绝大多数人对于去了美国之后的情景，是没有什么计划和预见的。没有
 计划和预见，就不会对自己学成之后到底是否回国以及回国到底有什么切实可行和具体的计
 划，因此也就容易导致拒签。而李云却把她丈夫回国的计划说得如此生龙活虎，跃然纸上，真是
 不签也得签。
  在本文的后面，我把签证官第二次拒签的书面理由附录在这里，签证官冷酷的文字，真令
 人感到心寒。同时我还把李云自己起草的申诉信附录在后面，读者可以从中看到两封信的巨大
 差异，从而也猜想这两封信的效果的巨大差异。如果李云直接把她自己的申诉信递交进去，是
 很难说服签证官的。
                               附录:使馆拒签信原文
   Dear Madam:
  From Pay stubs on file and student case notes, invitor receives funding of $22,000.OO.
 Student case notes indicate tuition fees are $9772 per annum. This leaves a net income
 of $12 ,228 ,which is insufficient to support a spouse visiting a student (student
 financial guidelines require $14,000 net income per annum).
  Applicant has a university degree and is currently employed as an accountant in a
 science and technology trade company.
  I am not convinced that this visit will be for a temporary purpose : subject would be
 able
 to change her status from within CDA (Canada) , thereby remaining employed while
 spouse completes studies. Subject has not demonstrated sufficient ties to the PRC that
